Terms of Service

The short version: Use BackpackBuddy to organize your kids' school emails. Pay on time. Don't abuse the service. We'll do our best to keep things running smoothly.
1. Agreement to Terms
By accessing or using BackpackBuddy ("the Service"), provided by Cultivate Data Solutions, LLC ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
2. Description of Service
BackpackBuddy is an email-scanning and calendar-management tool that:
- Scans your Gmail for emails from teacher email addresses you specify
- Extracts homework assignments, school events, and deadlines
- Creates events on your Google Calendar
- Saves email attachments to your Google Drive
- Archives processed teacher emails from your inbox
- Sends you a daily digest summary
3. Eligibility
You must be at least 18 years old and a parent or legal guardian of a school-aged child to use BackpackBuddy. By using the Service, you represent that you have the legal authority to grant access to the Gmail account you connect.
4. Account & Google Authorization
- You must connect a Google account (Gmail) to use the Service.
- You authorize us to access your Gmail, Google Calendar, and Google Drive as described in our Privacy Policy.
- You are responsible for maintaining the security of your Google account.
- You may revoke our access at any time via Google Account Permissions.
5. Subscription & Billing
- Free trial: New subscribers receive a 30-day free trial. No charge during the trial period.
- Billing: After the trial, your subscription renews monthly at the rate for your chosen plan (Basic, Family, or Premium) until cancelled.
- Payment: Payments are processed securely by Stripe. We accept major credit cards and Google Pay.
- Cancellation: You may cancel at any time. Your service continues through the end of the current billing period. No refunds for partial months.
- Price changes: We will notify you at least 30 days before any price increase. You may cancel before the new price takes effect.
6. Plan Limits
- Basic: 1 child, 1 teacher email address
- Family: Up to 4 children, up to 4 teacher email addresses
- Premium: Unlimited children and teacher email addresses
If you exceed your plan's limits, we'll notify you and ask you to upgrade or remove extra entries.
7. Acceptable Use
You agree NOT to:
- Use the Service for any purpose other than organizing school-related emails
- Provide email addresses that are not your children's teachers
- Attempt to access other users' data or accounts
- Reverse-engineer, decompile, or attempt to extract the source code of the Service
- Use the Service to send spam or unsolicited messages
- Resell or redistribute the Service without our written permission
8. Service Availability
- We strive to keep BackpackBuddy available 24/7, but we do not guarantee uninterrupted service.
- Scheduled maintenance will be communicated in advance when possible.
- We depend on Google's APIs. If Gmail, Calendar, or Drive experience outages, our Service may be temporarily affected.
9. Accuracy & Limitations
BackpackBuddy uses AI to extract information from teacher emails. While we strive for accuracy, we cannot guarantee that every homework assignment, event, or deadline will be captured correctly. Always verify important dates and deadlines independently.
- We are not responsible for missed assignments, events, or deadlines due to inaccurate extraction.
- We are not responsible for teacher emails that are not sent, are sent to a different email address, or use a communication platform other than email.
- The Service works best with English-language emails. Other languages may have reduced accuracy.
10. Intellectual Property
The Service, including its design, features, and code, is owned by Cultivate Data Solutions, LLC. Your content (emails, calendar events, files) remains yours. We claim no ownership over any data in your Google account.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CULTIVATE DATA SOLUTIONS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, MISSED DEADLINES, OR MISSED SCHOOL EVENTS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Cultivate Data Solutions, LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
13. Termination
- You may cancel your subscription at any time.
- We may suspend or terminate your account if you violate these Terms.
- Upon termination, we will delete your OAuth tokens and account data as described in our Privacy Policy.
- All calendar events and Drive files created by the Service remain in your Google account after termination.
14. Governing Law
These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Montgomery County, Maryland.
15. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Continued use after changes constitutes acceptance.
